These Terms of Use ("Terms") are a legal agreement between you and the developer of Goldfish, Liam Richards ("we," "us," "our"), governing your use of the Goldfish app (the "App"). By downloading or using the App, you agree to these Terms. If you don't agree, don't use the App.

The short version. Goldfish is a friendly memory-training companion — a game, not a medical product. Your memories and photos stay on your device. Goldfish+ is an optional auto-renewing subscription. Be kind, use it for its intended purpose, and understand it makes no medical or diagnostic claims.

1. What Goldfish is

Goldfish is a memory-training companion app centered on a friendly pet goldfish. It prompts you to write down everyday moments, quizzes you on them, and tracks light "trait" scores for fun. It is a general-purpose wellness and entertainment app, not a medical device or clinical tool. Goldfish does not diagnose, treat, cure, or prevent any condition, does not provide medical, psychological, or health advice, and makes no claim about memory loss, dementia, or any medical outcome. Don't rely on it for any medical decision; talk to a qualified professional for that.

2. Apple's Standard EULA

The App is licensed, not sold, to you. This license is governed by Apple's standard Licensed Application End User License Agreement (the "Standard EULA"), which is incorporated into these Terms by reference, together with the additional terms below. If anything here conflicts with the Standard EULA, these Terms control to the extent permitted. You acknowledge that this agreement is between you and us only — not Apple — and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

3. Your content

"Your Content" means the memories, notes, answers, and photos you create or add in the App. You keep ownership of Your Content. Almost all of it — including every photo — stays only on your device and is never sent to us, as described in our Privacy Policy. You are responsible for Your Content and for keeping your own backups if you want them; because it lives on your device, deleting the App or clearing its data permanently removes it, and we cannot recover it.

4. AI Randomized Recall

Goldfish+ includes an optional feature, AI Randomized Recall, that turns a memory you choose into a recall question and grades your answer. Only when you use it, the text of that memory (and, when grading, your typed answer) is sent over an encrypted connection through our stateless relay to an AI provider (Anthropic's Claude) to generate and score the question, then returned to your device. No name, account, or device identifier is attached, the relay stores nothing, and your photos are never sent. The questions and scores are automated and for practice and entertainment; they are not assessments of your health or ability. See the Privacy Policy for full detail.

5. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use, subject to these Terms and the Standard EULA. You agree not to:

• reverse engineer, decompile, or attempt to extract source code, API keys, or credentials from the App or its backend, except to the limited extent that applicable law expressly permits;
• abuse, overload, probe, or attempt to circumvent the usage limits or security of our backend service, or use it other than through the App as intended;
• use the App for any unlawful purpose or in violation of these Terms or the Standard EULA;
• resell, redistribute, or commercially exploit the App or any part of it.

6. Subscriptions and billing

Goldfish offers an optional auto-renewing subscription, Goldfish+, at $11.99 per month following a 3-day free trial for new subscribers. Goldfish+ unlocks AI Randomized Recall, the weekly and monthly recaps, and exclusive fish skins.

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel anytime in your device's Settings → your Apple Account → Subscriptions. Cancelling stops future renewals; you keep Goldfish+ until the end of the paid period.
• If you start a subscription during a free trial, any unused portion of the trial is forfeited.
• Prices are shown in the App before you purchase and may change with notice as permitted by Apple.

Cosmetic items for your goldfish are earned in-app with Stars and involve no real money; they are not a purchase and have no cash value.

7. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate. Again: Goldfish is a wellness and entertainment companion, and its prompts, questions, scores, and "trait" measures are for engagement and practice only — not medical, psychological, or diagnostic findings.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or relating to your use of the App or Your Content. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.

9. Indemnification

You agree to indemnify, defend, and hold harmless us and our service providers from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the App, your violation of these Terms, or your violation of any law or any third party's rights.

10. Changes

We may update these Terms from time to time. When we do, we'll revise the effective date above. Significant changes may also be noted in the App. Continuing to use the App after a change means you accept the updated Terms.
